Welcome to Words in Hat! These Terms of Use ("Terms") govern your access to and use of the Words in Hat mobile application ("App"). By downloading, accessing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the App.

1. Acceptance of Terms

By using Words in Hat, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. These Terms constitute a legally binding agreement between you and Words in Hat.

2. License Grant

2.1 Limited License

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to:

  • Download and install the App on your personal device(s)
  • Use the App for personal, non-commercial entertainment purposes
  • Access the features and content available in the App

2.2 Restrictions

You agree NOT to:

  • Copy, modify, distribute, sell, or lease any part of the App
  • Reverse engineer, decompile, or attempt to extract the source code of the App
  • Remove, alter, or obscure any copyright, trademark, or other proprietary rights notices
  • Use the App for any illegal or unauthorized purpose
  • Interfere with or disrupt the App or servers or networks connected to the App
  • Use any automated means to access the App or collect data from the App
  • Impersonate any person or entity or misrepresent your affiliation with any person or entity

3. User Accounts and Subscriptions

3.1 Free Version

The basic version of Words in Hat is available for free with limited features.

3.2 Premium Features

Certain features and content may require a subscription or in-app purchase. By purchasing a subscription, you agree to:

  • Pay the applicable fees for the subscription tier you select
  • Automatic renewal of your subscription unless cancelled
  • The terms and conditions of the applicable app store (Apple App Store, etc.)

3.3 Subscription Management

You can manage and cancel your subscription through your device's account settings. Cancellations take effect at the end of the current billing period.

3.4 Refund Policy

Refunds are handled according to the policies of the app store through which you made your purchase. We do not directly process refunds.

4. User-Generated Content

4.1 Content You Create

The App allows you to create and save content, including:

  • Player names and team names
  • Custom word lists
  • Game statistics and history

4.2 Content Ownership

You retain ownership of any content you create. By using the App, you grant us a license to store and process your content solely for the purpose of providing the App's features.

4.3 Content Guidelines

You agree not to create or save content that is:

  • Illegal, offensive, defamatory, or inappropriate
  • Infringing on intellectual property rights
  • Harmful, threatening, or harassing
  • Contains personal information of others without consent

5. AI-Generated Words

5.1 AI Services

The App uses third-party AI services (DeepSeek and Gemini) to generate words based on your selected themes and difficulty levels.

5.2 Content Quality

While we strive to provide appropriate and relevant content, we do not guarantee:

  • The accuracy, appropriateness, or quality of AI-generated words
  • That AI-generated content will be free from errors or inconsistencies
  • Availability of AI services at all times

5.3 Content Review

You are responsible for reviewing AI-generated words before using them in your game. If you encounter inappropriate content, please report it to us.

6. Intellectual Property Rights

6.1 Our Property

The App and all its content, features, and functionality are owned by Words in Hat and are protected by copyright, trademark, and other intellectual property laws.

6.2 Trademarks

"Words in Hat" and related logos are trademarks of Words in Hat. You may not use these trademarks without our prior written permission.

6.3 Feedback

If you provide feedback, suggestions, or ideas about the App, you grant us the right to use such feedback without any obligation to you.

7. Privacy and Data Protection

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your information.

8. Third-Party Services

8.1 Third-Party Providers

The App integrates with third-party services, including:

  • Firebase (Google) for analytics and crash reporting
  • DeepSeek API for word generation
  • Gemini API (Google) for word generation
  • Apple StoreKit for subscriptions and purchases

8.2 Third-Party Terms

Your use of these third-party services is subject to their respective terms and policies. We are not responsible for third-party services or their content.

9. Disclaimers and Limitations of Liability

9.1 "As Is" Basis

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

9.2 No Warranty

We do not warrant that:

  • The App will be uninterrupted, secure, or error-free
  • Defects will be corrected
  • The App is free from viruses or harmful components
  • Results from using the App will meet your expectations

9.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL WORDS IN HAT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF OR RELATED TO YOUR USE OF THE APP.

9.4 Maximum Liability

Our total liability to you for all claims arising from your use of the App shall not exceed the amount you paid to us in the twelve (12) months preceding the claim, or $100, whichever is greater.

10. Indemnification

You agree to indemnify, defend, and hold harmless Words in Hat and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, costs, or expenses arising from:

  • Your use of the App
  • Your violation of these Terms
  • Your violation of any rights of another person or entity
  • Content you create or share through the App

11. Termination

11.1 Termination by You

You may stop using the App at any time by uninstalling it from your device.

11.2 Termination by Us

We reserve the right to suspend or terminate your access to the App at any time, with or without notice, for:

  • Violation of these Terms
  • Fraudulent, abusive, or illegal activity
  • Any other reason at our sole discretion

11.3 Effect of Termination

Upon termination, your right to use the App will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive.

12. Changes to the App

We reserve the right to:

  • Modify, suspend, or discontinue any feature of the App
  • Change pricing for subscriptions or in-app purchases
  • Update the App to improve functionality or security

We will make reasonable efforts to notify you of significant changes, but we are not obligated to do so.

13. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by:

  • Posting the updated Terms in the App
  • Updating the "Last Updated" date
  • Sending you a notification (for significant changes)

Your continued use of the App after changes become effective constitutes your acceptance of the updated Terms.

14. Governing Law and Dispute Resolution

14.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Words in Hat operates, without regard to conflict of law principles.

14.2 Dispute Resolution

Any dispute arising from these Terms or your use of the App shall be resolved through:

  1. Good faith negotiations between the parties
  2. Mediation, if negotiations fail
  3. Binding arbitration or court proceedings, as a last resort

14.3 Class Action Waiver

You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.

15. Miscellaneous

15.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Words in Hat regarding the App.

15.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

15.3 Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

15.4 Assignment

You may not assign or transfer these Terms or your rights under these Terms without our prior written consent. We may assign these Terms without restriction.
